HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 12376 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No. 275 of 2025, under sections 64(1) BNS, P.S. Leelapur, District Pratapgarh. 3. Learned counsel for the applicant argues that in terms of FIR it was alleged that the applicant used to work at the home of the informant and daughter of informant who is slightly mentally challenged was enticed by the applicant and physical relation were formed. The tentative age of the victim is around 19 years. In the statement under Section 180 BNSS the victim stated that she was sleeping at home when the applicant took her to nearby jungle and committed wrong on her. Somewhat similar statement was given under Section 183 BNSS. Medical on record does not corroborate the allegations of use of any force. Even in terms of two statements prima facie the allegations with respect to victim being mentally challenge are non evident. 4. Learned AGA has opposed the bail application. 5.
