HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 7215 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. In the prosecution case, it is alleged that the accused kidnapped a 10-year- old child and kept him in an apartment, from where he was subsequently recovered by the police. Learned counsel for the applicant submits that the applicant has no criminal antecedents and is in custody since 18.05.2025. It is further submitted that PW-1 (the complainant) and PW-2 (the victim) have been examined before the trial court, and both have been declared hostile as they did not support the prosecution case. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned AGA has opposed the bail application but does not dispute that both PW-1 and PW-2 have been declared hostile. Considering the statements of PW-1 and PW-2, the fact that the applicant is in custody since 18.05.2025, has no criminal antecedents, and is only twenty years old, this Court finds it a fit case for granting bail to the applicant. Accordingly, the bail application is allowed. Versus Counsel for Applicant(s) : Harish Chandra Yadav, Osama Syed, Ram Suphal, Riyaz Ahmad Counsel for Opposite Party(s) : G.A.
