With the consent of learned counsel for the parties, matter is heard at this stage. 2. Petitioner is seeking pension as per notification dated 04.05.2023 under the Old Pension Scheme, i.e. CCS (Pension) Rules, 1972, from due date with all incidental benefits. -2- 3. Petitioner submits that petitioner had exercised option for switching over to the Old Pension Scheme under the CCS (Pension) Rules, 1972, vide Annexure P-2. However, till date the respondents have not taken any decision in the matter. 4. Considering the limited grievance of the petitioner raised in this petition, this writ petition is disposed of with directions to respondent No.2/Competent Authority to consider the option exercised by the petitioner vide Annexure P-2, for determining his eligibility for pension under the Old Pension Scheme/CCS (Pension) Rules, 1972, in accordance with law within a period of four weeks from today.
