Heard learned counsel appearing on behalf of the parties. 2. This is a writ petition under Article 226 of the Constitution of India, wherein the petitioner is aggrieved by the rejection of the claim of the petitioner under the Mukhymantri Krishak Durghatna Kalyan Yojana, 2020 on the ground that the other family members of the petitioner refused to provide a consent letter for the claim of the petitioner with regard to the payment. 3. Learned counsel appearing on behalf of the respondents submits that the scheme requires the consent of the family members . 4. Upon perusal of the documents, it appears that the petitioner is the wife of the deceased and there is no dispute on the said fact. In such circumstances, we do not see any reason as to why the benefit of the scheme should not be given to the wife, even though, the other family members of the deceased have not provided the no objection certificate as required under the law. 5. In light of the same, we quash and set aside the impugned order and direct the authorities concerned to carry out a further inquiry, grant an opportunity of hearing to the petitioner, and thereafter pass a reasoned order within a period of 8 weeks from date.
