HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 12385 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J. 1. Heard learned counsel for the applicant, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No.191 of 2025, under sections 115(2), 351(3), 352, 105 BNS, P.S. Bachhrawan, District Raebareli. 3. Learned counsel for the applicant argues that in terms of FIR it was alleged that mother of informant was beaten up by accused who were son and daughter in law of the deceased with the use of lathi danda etc which resulted in substantial injuries. Subsequently the victim died. Cause of death as per post mortem report is ante mortem septicenia as noted. 5 injuries were noted on the body of the deceased and none of them are on vital parts. The applicant is son. 5. Learned AGA has opposed the bail application. 6. Considering the post mortem report and the fact that injuries were on non vital parts prima facie intent for offence under Section 105 is apparently missing, however, without commenting upon the merits of the case, the applicant who is in jail since 18.5.2025 and has no criminal history is entitled to be enlarged on bail. In view thereof, the application is allowed. 7. Let the applicant Deepu Pasi be released on bail in aforesaid FIR Versus Counsel for Applicant(s) : Jaikaran Counsel for Opposite Party(s) : G.A.
