Accused no.1 in Crime No.203/2024 registered by K.R.Sagar Police Station, Mandya District, for the offences punishable under Sections 115(2), 126(2), 3(5), 324, 351(3), 352, 54, 74, 76 of BNS, 2023, is before this Court under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.203/2024 was registered by K.R.Sagar Police Station, Mandya District, for the aforesaid offences against the petitioner herein and others on the basis of the first information dated 19.12.2024 received from Rathnamma W/o M.C.Nagesha. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.5407/2024 before the jurisdictional Sessions Court, which was rejected on 16.01.2025. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that in respect of the alleged incident that had taken place on 18.12.2024, FIR in Crime No.202/2024 was registered by K.R.Sagar Police Station, Mandya District, against Ravikumar - 3 - NC: 2025:KHC:11755 CRL.P No. 3435 of 2025 and six others for the offences punishable under Sections 115(2), 118(1), 189(2), 190, 324(4), 329(4), 351(2), 352 of BNS, 2023, based on the first information dated 18.12.2024 received from the petitioner herein. The present FIR in Crime No.203/2024 has been registered belatedly on 19.12.2024 on the basis of the first information received from Rathnamma who is the wife of Nagesh, arrayed as accused no.4 in Crime No.202/2024. 5. Considering the aforesaid aspects of the matter and also considering the nature of allegations found in the first information which is submitted belatedly, I am of the opinion that petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.203/2024 registered by K.R.Sagar Police Station, Mandya District, for the offences punishable under Sections 115(2), 126(2), 3(5), 324, 351(3), 352, 54, 74, 76 of BNS, 2023, subject to the following conditions: - 4 - NC: 2025:KHC:11755 CRL.P No. 3435 of 2025 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
