Order 18/04/2026
1. By way of filing the instant review petition, a prayer has been made to recall the order dated 24.09.2024 passed by this Court while deciding S.B. Civil Writ Petition No. 7462/2009 submitted by the respondent.
2. Counsel for the petitioner submits that the dispute raised by the respondent is liable to be decided as per the provisions contained under the Life Insurance Corporation of India (Agents) Regulations, 1972 (for short “Regulation of 1972”) as her dispute pertains to the year 2006 but while deciding the aforesaid writ petition submitted by the respondent, the same has been decided in the light of the provisions contained under the Life Insurance Corporation of India (Agents) Regulations, 2017 (for short
“Regulation of 2017”) and the Regulation of 2017 does not have retrospective effect but the same has prospective effect,
(2 of 2) [WRW-22/2025] therefore, the provisions of the Regulations of 1972 would be applicable while adjudicating the dispute raised by the respondent, hence, the order dated 24.09.2024 be recalled/modified and the writ petition submitted by the respondent be restored to its original number.
3. Per contra, counsel for the respondent opposes the
arguments raised by counsel for the petitioner but he is not in a position to controvert the submissions made by counsel for the petitioner.
4. Heard and considered the submissions made at Bar and perused the material available on record.
5. Considering the arguments raised by counsel for the petitioner and looking to the fact that the dispute raised by the respondent pertains to the year 2008, hence under these circumstances, the dispute is required to be decided as per the Regulation of 1972 and not as per the Regulation of 2017 but in the order dated 24.09.2024, a direction has been issued in terms of the Regulation of 2017.
6. Considering the overall facts and circumstances of the case, the order dated 24.09.2024 is recalled and the S.B. Civil Writ Petition No. 7462/2009 is restored to its original number.
7. Office to proceed.
