MP(M) No. 2536/2025 Reply to the application has been filed, wherein, contents of the application are denied and dismissal of the same has been prayed. Heard. Having regard to the averments made in the application, which is duly supported by an affidavit of the applicant, this Court finds sufficient cause to condone the delay that has occurred in filing the present revision petition. Consequently, the application is allowed and delay that has occurred in filing the present revision petition, is condoned. The application stands disposed of. Cr. Revision No. /2026 Petition be registered. Mr. Jaidev Thakur, Advocate, accepts service of notice on behalf of the respondent. As prayed, list for hearing on admission after four weeks. Cr. As the main petition is pending adjudication, it is ordered that the substantive sentence imposed upon the applicant/petitioner, vide judgment of conviction, dated 22.12.2022 and order of sentence, dated 13.02.2023, passed by the learned Additional Chief Judicial Magistrate, Shimla, District Shimla, H.P. and affirmed by learned Additional Sessions Judge-1, Shimla, District Shimla, H.P. vide judgment dated 20.05.2024, shall remain suspended, till final disposal of the petition, subject to his depositing 30% of the compensation amount, in addition to the amount already deposited by him before the learned trial Court and furnishing personal bond in the sum of Rs. 50,000/- with one surety in the like amount to the satisfaction of learned trial Court within a period of four weeks, undertaking therein to appear in the Court as and when directed and in the event of the dismissal of the petition, the applicant will surrender before the Court to undergo sentence, if any, imposed by the Court.
