HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 8180 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J. 1. Heard learned counsel for the applicant as well as learned A.G.A. and Dr. Pooja Singh, learned Counsel for the informant and perused the record. 2. The applicant seeks enlargement on bail in FIR No.357 of 2025, under Section 85, 80 of BNS and Section 3/4 of D.P. Act, Police Station Kotwali Nagar, District Gonda. 3. In terms of the FIR, it was alleged that the sister of the informant was married to the applicant in the year 2022. It was alleged that the sister informed that the applicant was having illicit relation out side marriage and allegation of demand of dowry was also levelled against the entire matrimonial family. Subsequently, she was beaten and forced to take poison. The victim was admitted to the hospital and she died. 4. In the light of the said allegation, the Counsel for the applicant draws my attention to the psychiatrist report wherein the victim was admitted with the history of harpic consumption 30 minutes prior to admission. The Counsel for the applicant states that on the earlier occasion, the victim had tried to commit suicide as noticed in para 6 of the order dated 30.05.2025 passed in Criminal Misc. Anticipatory Bail Application U/S 482 BNSS No.581 of 2025, which is filed as Annexure-9 to the bail application. Versus Counsel for Applicant(s) : Ishan Baghel, Nishchal Verma Counsel for Opposite Party(s) : G.A., Abhishek Yadav, Ashutosh Singh, Dr. Pooja Singh Alok Singh .....Applicant(s) State Of U.P. Thru. Addl. Chief Secy. Home Lko. .....Opposite Party(s) 5. The Counsel for the informant strongly opposes the bail application by arguing that the applicant had not taken proper medical care to the deceased and only the brother had taken her to hospital. 6. Learned A.G.A. also vehemently opposed the bail prayer. 7. Considering the fact that the victim died on account of consumption of hydrochloric acid as is evident from the FSL report and there being nothing against the applicant to suggest that soon before her death, the victim was subjected to any physical or mental harassment in relation to any demand of dowry coupled with the fact that the applicant has no criminal antecedents and is languishing in jail since 10.05.2025, I am of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed. 8. Let the applicant Alok Singh be released on bail in the abovesaid first information report number on his furnishing personal bonds and two reliable sureties of Rs.20,000/- each to the satisfaction of the court concerned with the following conditions: (a) The applicant shall execute a bond to undertake to attend the hearings; (b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
