A case has been registered aga'InSt the Petitioner and Others for the offences punishable under sections 8(c) r/w 20(b)(ii)(C) of the Narcotic Drugs and Psychotrop'lc Substances Act, 1985. 3. Case of the prosecution, in brief, iS that, On 07.01.2025 at 5.30 p.m., on information about 'lllegal transportation of ganja, CI of police, Nand'lgama Police Station along with his Staff and mediators proceeded near to y Junction, on the Service road adjacent tO NH-65 near the outskirts of Nandigama Town, at the mud road leading tO Lakshmipuram Colony and found White COIour Wolks Wagon Car bearing No.MH 03 AZ 8056 loaded with 120 KGs of ganja. The vehicle, along with contraband, was confiscated and investigated into. Learned counsel for the petitioner submits that the petitioner was shown as Accused No.1 basing on the confessional statement of co-accused. 5. Learned Assistant Public Prosecutor submits that major portion of the investigation has been completed. 6. Heard. Perused the record. 7l Basing on the confessional statement of co-accused, a case has been registered against the petitioner herein and the petitioner herein was not apprehended at the scene of offence. The petitioner was arrested and sent to judicial remand on 13.O3.2025 and since then he is in jail. Considering the facts and circumstances of the case, this Court is inclined to release the petitioner on bail. 8. Accordingly, the Criminal Petition is allowed. The petitioner/ Accused No.2 shall be released on bail on executing a personal bond for Rs.10,00O/-(Rupees Ten Thousand only) with two sureties for the like sum to the satisfaction of the learned I Additional Distr|lct & Sessions Judge, Machilipatnam.
