Babbu Yadav Babu Lal Yadav and others" arising out of Case Crime No.023/2025, under section 191 (2), 115 (2), 352, 333, 324 (4), 351 (3) of BNS/147, 323, 504, 452, 427, 506 of IPC, Police Station Hathigawan, District Pratapgarh, pending before learned Additional Chief Judicial Magistrate Kunda, Pratapgarh, ii. quash the impugned chargesheet No.01, dated 30.03.2025 filed under section 191 (2), 115 (2), 352, 333, 324 (4), 351 (3) of BNS/147, 323, 504, 452, 427, 506 of IPC, Police Station Hathigawan, District Pratapgarh as, contained as Annexure No.1 to this application, and iii. quash the impugned summoning order dated 03.06.2025 issued by learned Additional Chief Judicial Magistrate, Kunda, Pratapgarh in Case No.2709 of 2025 "State Vs. Babbu Yadav @ Babu Lal Yadav and others", contained as Annexure No.2 to this application. Learned counsel for the applicants after arguing at length, does not want to press this case on merits, however, he submits that he is ready to move discharge application before the court below. In case the applicants move application for discharge within 2 weeks from today through counsel, same will be decided by the court below within 4 Versus Counsel for Applicant(s) : Shiv Kumar Yadav, Prem Kumar Verma Counsel for Opposite Party(s) : G.A.
