2. This bail application has been filed by the petitioners namely, (i) Jogesh Das (ii) Rafik Ali and (iii) Jyotish Baro under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, seeking regular bail in connection with Barama P.S. Case No.74/2025 under Section 303(2) of BNS, 2023.
3. Case diary is received and perused.
4. The allegation against the present petitioners is regarding theft of electrical items including conductor (MVCC) from the top of electrical poles. The said items were loaded in two vehicles, which were involved in the theft. However, it appears that no recovery was made from the possession of the present petitioners. In the meantime, the petitioners have spent 56 days in custody and the statutory period of detention of 60 days is going to be over soon.
5. Considering the above, the prayer for bail is allowed.
6. Accordingly, the petitioners, named above, shall be released on bail on furnishing a bond of Rs.50,000/- (Rupees Fifty Thousand) each with two sureties of the like amount to the satisfaction of the learned C.J.M., Baksa,
Page No.# 3/3 Mushalpur in connection with the aforementioned case. The direction for bail is further subject to the conditions that the accused petitioners – (1) shall not hamper the investigation and tamper with the evidence of the case; and (2) shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
7. In terms of the above, this bail application stands disposed of.
