HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 10637 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant as well as learned AGA for the Nirmal Yadav, Advocate who has filed Vakalatnama on behalf of the complainant which is taken on record. The present bail application has been filed seeking the release of the applicant in Case Crime No. 276/2025, under Sections 115(2), 351(3), 352, 190, 191(2), 191(3), 109 of the B.N.S. and Section 3 of the Explosive Substances Act, registered at Police Station Dariyabad, District Barabanki. The case arises from an FIR lodged on 29.07.2025 against five named persons, including the applicant, alleging that while the informant’s cousin was going to attend the call of nature at about 08:00 a.m. on 29.07.2025, all the accused persons assaulted him with lathis, dandas, a farsa, a country- made pistol, and a country-made bomb due to old enmity. It is alleged that applicant No. 2 was carrying a country-made pistol. Another accused allegedly used a country-made bomb, causing injuries to the victim. In the affidavit supporting the bail application, it is stated that the applicant is innocent and has been falsely implicated.
Learned counsel for the applicant argues that the site plan indicates the incident took place in front of the applicant’s house and that the occurrence began when the victim himself provoked the attack and sustained injuries from the country-made bomb he was carrying. Criminal antecedents relating Versus Counsel for Applicant(s) : Harsh Vardhan Shahi, Shalu Pandey Counsel for Opposite Party(s) : G.A., Nirmala Yadav Ravindra @ Ravendra .....Applicant(s) State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Home Lko. .....Opposite Party(s)
to one case have been explained in paragraph 14 of the bail application. It is further submitted that co-accused Naumilal and Dharmendra, who have been assigned similar roles, have already been granted bail by this Court vide order dated 25.09.2025 in Criminal Misc. Bail Application No. 9177 of
2025. Parity with the said order has been sought. On the other hand, learned A.G.A. has opposed the bail application, submitting that the allegations have been substantiated during the investigation, which is still underway.
Learned counsel for the complainant has also opposed the application, stating that the victim suffered serious injuries; all the accused participated in the assault; and the applicant has not denied his presence at the scene of occurrence. Upon due consideration, it appears that the role attributed to the present applicant is similar to that of co-accused Naumilal and Dharmendra, this position not being disputed by the learned AGA. No specific allegation is made against the applicant. Considering the injury report and the fact that the applicant is in custody since 29.07.2025, I find it to be a fit case for granting bail to the applicant on the ground of parity. Accordingly, the bail application is allowed. Let the applicant Ravindra @ Ravendra involved in Case Crime No. 276/2025, under Sections 115(2), 351(3), 352, 190, 191(2), 191(3), 109 of the B.N.S. and Section 3 of the Explosive Substances Act, registered at Police Station Dariyabad, District Barabanki, be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions which are being imposed in the interest of justice:- (i) The applicant will not tamper with the evidence during the trial. dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence. (iv) The applicant shall file an undertaking to the effect that he shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. (v) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel. In case of his absence, without sufficient cause, the trial court may proceed against him in accordance with law.
(vi) In case, the applicant misuses the liberty of bail during trial and in order to secure his presence proclamation under Section 82 Cr.P.C. (now Section 84 BNSS) is issued and the applicant fails to appear before the court on the date fixed in such proclamation, then, the trial court shall initiate proceedings against him, in accordance with law under Section 174-A IPC (now Section 209 of BNS).
