ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 1939 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. 1.The present anticipatory bail application has been filed seeking anticipatory bail in case crime No.495 of 2025 under sections 191(2), 191(3), 115(2), 351(3), 352, 109(1) BNS, P.S. Maurawan, district Unnao. 2.Heard learned counsel for the applicant, Mr. Anu Pratap Singh, learned counsel for respondent No.2 who has filed vakalatnama which is taken on record, and Mr. Rajeev Kumar Verma, learned Additional Government Advocate-I for the State. 3.Learned counsel for the applicant submits that the applicant has been falsely implicated. Both side(s) have sustained injures. Three persons are injured from the applicant side and three were from the complainant side. 4. Learned Addl. Government Advocate and complainant's counsel have opposed the prayer made by applicant's counsel. It is submitted by learned A.G.A. that there are three injured in this case. The injured Ram Bahadur, Jitendra and Dhirendra have sustained three injuries. All have suffered lacerated wounds. Condition of the injured is such that the statement of the injured witnesses could not be recorded as on date. The complicity of the applicant is prima facie evident. No case for anticipatory bail is made out and the application is liable to be rejected. 5.I have considered the submission and perused the record. And Another .....Opposite Party(s) The trial court while rejecting the the application for anticipatory bail has recorded the following observation (s) : " अिभयोजन का तकर् है िक मामले में अन्य सह अिभयु्वों के साथ िमलकर अिभयु्व सौरम के बांका से वादी प्ष पर जानलेवा हमला िकये जाने का अिभकथन है िजसके पिरणामस्वरूप वादी के िपता व भाई को गंभीर चोटें आयी है तथा चोटिहल रामबहादुर, िजतेन््श व धीरेन््श सी०एच०सी० मौरावां उन्नाव से रेफर िकये जाने के उपरान्त मरणासन्न हालत में ्िामा सेंटर एस०पी०जी०आई० लखनऊ में भतर् हुए हैं। वादी मुकदमा के ्षारा अपने बयान अस्तगत धारा 180 बी०एन०एस०एस० में ्ऺाथिमकी में उिल्लिखत तथ्यों का समथर्न िकया है। अिभयु्वगण ्षारा पहुंचायी गयी चोटों के सम्बन्ध में डाक्टर अमन िरजवी ने के स डायरी के पचार् नं० 3 पर अंिकत अपने बयानों में बताया है िक गजरूबंगण को उपचार हेतु पिरजनों ्षारा लाया गया था तथा मजरुबगण रामबहादुर, िजतेन््श व धीरेन््श की हालत मरणासन्न िस्थित में थी तथा हालात को देखते हुए तत्कालीन मजरूबगण को ्िामा सेंटर लखनऊ में रेफर िकया गया था। दौरान िववेचना संकिलत िचिकत्सीय साष्य से यह भी स्प्ि है िक चोटिहल रामबहादुर के दो ददर् की चोट के अितिर्व पांच चोट Lacerated Wound की आना मेिडको लीगल िरपोटर् में अंिकत है। मेिडको लीगल िरपोटर् में चोटिहल धीरेन््श के शरीर पर दो ददर् की चोटों के अितिर्व तीन चोट Lacerated Wound की अंिकत हैं। मेिडको िरपोटर् में चोटिहल िजतेन््श के शरीर पर एक चोट ददर् की होने के अितिर्व तीन चोट Lacerated Wound की अंिकत हैं। चोटिहल रामबहादुर की एस०पी०जी०आई० लखनऊ की िडस्चाजर् समरी के अनुसार उसके FRACTURE BOTH BONE FOREARM (Right)+UNDISPLACED PROXIMAL TIBIA LATERAL CONDYLE FRACTURE (Right)+Right Temporo- Parietal-Occipital SAH with Left Occipital Contusion अंिकत है जो िक अत्यन्त गंभीर चोट है। अतः मामले के तथ्य एवं पिरिस्थितयों में अिभयु्व को अि्षम जमानत पर छोड़े जाने का आधार पयार्प्त नहीं है तथा अि्षम जमानत ्ऺाथर्ना प्ऴ िनरस्त िकये जाने योग्य है।" 6.Considering the above aspects of the matter, perusal of the record, injury report of three injured witnesses which according to the doctor is grievous in nature, complicity of the applicant is prima facie evident and the offence is punishable with life, no case for anticipatory bail is made out. 7.The application is accordingly dismissed.
