2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the injuries caused to injured Golu were sudden and without any pre-meditation. The injured intervened in between the petitioner and Tejmal and accidentally sustained injury at his right eye. There was no intention of the petitioner to cause such injury. The petitioner is in custody since 06.05.2025 and trial of the case may take considerable time, and there are no criminal antecedents against the petitioner, therefore, the bail application of the accused-petitioner may be allowed.
[2025:RJ-JP:30845] (2 of 2) [CRLMB-6914/2025]
3. Learned Public Prosecutor as well as learned counsel for the complainant have vehemently opposed the bail application and contended that injured Golu sustained grievous injury at his right eye and lost his vision due to injury caused by the petitioner, therefore, the bail application of the accused-petitioner may be dismissed.
4. Heard and perused the material available on record.
5. It is not desirable to express anything on the merits of the case. In the FIR, it is stated that injured admitted to intervene in the altercation took place between the petitioner Deepak Kumar and Tejmal and sustained injury at his right eye. Considering the above facts so also the fact that the charge-sheet has already been submitted and there are no criminal antecedents against the petitioner, I deem it just and proper to enlarge the accused- petitioner on bail.
6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Deepak Kumar S/o Hansraj, in connection with FIR No.88/2025 registered at Police Station Udhyog Nagar (Kota City), District Kota City shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
