Notice issued to respondent No.1(c) has been received back duly served, but none has put in appearance, the said respondent is proceeded against ex- parte.
By way of this application, a prayer has been made to condone the delay in filing the appeal against
judgment dated 18.11.2023 passed by the learned District Judge, Bilaspur in arbitration petition No.14 of
2019.
The delay is stated to be 154 days.
No reply has been filed by the respondents.
I have gone through the contents of the application, which is duly supported by the affidavit of competent authority. It is averred in the application that after receipt of certified copy of the order passed by the learned District Judge, Bilaspur, the matter had to be routed through various official channels for seeking administrative and legal approvals. From the averments made in the application, the applicant has been able to
justify the reasons for not presenting the appeal within time prescribed by law of limitation.
I am satisfied that reasons so stated by the applicant are bonafide. In result, the application is allowed. The delay in filing the appeal is condoned. The application stands disposed of.
