Accused No.4 in Crime No.13/2025 registered by Jalahalli Police Station, Bengaluru City, for the offences punishable under Sections 406, 420, 419, 465, 475, 506, 149 IPC and Sections 66(C) and 66(D) of the Information Technology Act, 2008, is before this Court under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.13/2025 was registered by Jalahalli Police Station, Bengaluru City, for the aforesaid offences against Arjun Adyanthyaya and others based on the first information dated 14.02.2025 received from Divya.K.P., W/o Dharmendra. Apprehending arrest in the said case, petitioner who was arrayed as accused No.4 in the FIR had filed Crl. Misc. No.1670/2025 before the jurisdictional Sessions Court which was rejected on 05.03.2025. Therefore, she is before this Court. 4. Learned Counsel for the petitioner submits that petitioner is an unmarried lady, who has been unnecessarily implicated in the case. The only allegation in the case is that petitioner was - 3 - NC: 2025:KHC:13129 CRL.P No. 3762 of 2025 present in the house when her father, who is arrayed as accused No.1 in the case received certain amounts from the first informant. Except the same, there is no other allegation against the petitioner. Accordingly, he prays to allow the petition. 5. Per contra, learned HCGP, who has opposed the petition, however, does not dispute the submission made by the learned Counsel for the petitioner. 6. A perusal of the material on record would go to show that first informant has averred in her first information that she got acquainted to accused No.1, who had promised to secure her a job and had demanded a sum of Rs.11 lakhs. It is stated in the first information that the first informant had paid the entire amount of Rs.11 lakhs to accused No.1 in his house and at that time, wife and daughter of accused No.1 were also present in the house. Except the aforesaid allegation, there is no allegation found as against the petitioner who is the daughter of accused No.1. She has undertaken to cooperate with the police for the purpose of investigation. Petitioner, as against whom FIR in Crime No.61/2025 was registered by - 4 - NC: 2025:KHC:13129 CRL.P No. 3762 of 2025 Byatarayanapura Police Station, Bengaluru City, on similar allegations, has been granted anticipatory bail by this Court in Crl.P.No.3560/2025 disposed of on 27.03.2025. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by her for grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following order:- 7. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of her arrest in Crime No.13/2025 registered by Jalahalli Police Station, Bengaluru City, for the offences punishable under Sections 406, 420, 419, 465, 475, 506, 149 IPC and Sections 66(C) and 66(D) of the Information Technology Act, 2008, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. - 5 - NC: 2025:KHC:13129 CRL.P No. 3762 of 2025 3. Petitioner shall not tamper with the prosecution witness and she shall co-operate with the police for investigation and appear before them whenever called upon. 4.
