SREENIVASA REDDY Criminal Petition No.5933 of 2025 Order: This Criminal Petition, under sections 48O and 483 of the BNSS, has been filed by the petitioner/A1, seeking regular bail, in Crime No.199 of 2023 of Narsipatnam Rural Police Station, Anakapalli District. 2. A case has been registered against the petitioner herein for the offences punishable under Sections 20(b)(ii)(B), 25 r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Case of the prosecution, in brief, is that on 28.12.2023 at about lO.0-0 hours, on receiving credible information about illegal transportation of ganja, HC 1105 of Narsipatnam Rural Police Station, along with his staff and mediators, proceeded to NeIIimetta Junction, and while conducting vehicle checking, they found one car bearing No.AP39 T J 6035 coming from Chintapalli side towards Narsipatnam side. On seeing the police party, the driver of the car got down from the car and escaped. On verification of car, 18 Kgs of ganJ®a Was found. The vehicle, along with contraband, was seized under the cover Of mediators report and later Al is apprehended. 4. Learned counsel for the petitioner submits that the petitioner was falsely implicated in the present crime. The quantity of Ganja .-r_ E== -=oD_ allegedly seized iS not a commercial quantity, and material Part Of the investigation -ls completed. 5. On the contrary, learned Assistant Public Prosecutor opposed the petitionIOn the ground that the investigation jS not ConPleted. 6. Heard. Perused the record. 7. The petitioner Was arrested and Sent tO judicial Custody On 10.05|2025 and since then he iS in jail. The quantity Of Ganja allegedly seized |ln the present case is 18 Kgs, which does not amount to commercial quantity. In view Of the aforesaid facts and circumstances of the case, request of the petitioner can be considered for bail. 8. Accordingly, the Criminal Pet.ition iS allowed.
