Present writ petition has been filed with the following prayers:- "(i) Issue a writ, order or direction in the nature of Mandamus commanding the opposite party no. 1 & 2 to consider the matter of petitioner and take appropriate action in the matter of petitioner in illegal encroachment over the Land Gata No. 49 holding of the petitioner, situated at Village Ghuri, Post-Melthuwa, Pargana-Ghuri (Dalmau), Tehsil-Dalmau, District-Raebareli. (ii) Issue a writ, order or direction in the nature of Mandamus commanding and directing to the opposite party No. 1 & 2 to ensure the lawful, requisition or acquisition in accordance with law and pay him compensation if acquired the petitioners land." 3. Shri Yogesh Chandra Bhatt, learned counsel appearing on behalf of State-respondent Nos.1 to 3, on instructions, submits that no construction is being carried out on Gata No.49 rather the construction is being carried out on Gata No.78.
