(now under section 528 B.N.S.S.) which is duly supported with an affidavit, it is most respectfully prayed that this Hon'ble court may graciously be pleased to quash the chargesheet No 1 dated 31-07-2024 as well as summoning order dated 19-10-2024 in case crime No. 65/2024 case no. 100400/2024 under section 420,406,506 IPC police station Kakori District Lucknow, State Vs. Brajendra Singh and another pending in the court of Additional Civil Judge (S.D.) Court No.20/Additional Chief Judicial Magistrate Lucknow." After arguing the matter at some length, learned counsel for the applicant(s) has submitted that liberty may be given to the applicant(s) to prefer a discharge application before the court below and the same may be directed to be decided expeditiously. Learned AGA has no objection to the prayer made by learned counsel for the applicant(s). Keeping in view the aforesaid, the present application is disposed of with liberty to the applicant(s) to move discharge application before the court below, if the charges have not been framed, which shall be decided expeditiously.
