[2025:RJ-JP:23278] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 6952/2025 Vijay Kumar Gurjar @ Bijju S/o Shri Ramnivas, Aged About 22 Years, R/o Luharwas, Police Station Sadar, Neem Ka Thana, District Sikar (Raj.) (Accused Presently Confined In District Jail, Sikar). ----Petitioner Versus The State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Arpan Kumar Sharma For Respondent(s) : Mr. R.S. Shekhawat, AGA HON'BLE MR. JUSTICE MANEESH SHARMA (V. J.) Order 16/06/2025 1. The instant bail application has been filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of the petitioner, who has been arrested in connection with FIR No.50/2025 registered at Police Station Neem Ka Thana Sadar, District Sikar for the offence punishable under Sections 332(c), 109(1), 308(2), 119(1), 125, 3(5) and 111(4) of B.N.S. and Section 27 of the Arms Act, 1959. 2. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case; he is in custody since 27.03.2025. He further submits that co-accused Krishan Kumar Gujar has already been released on bail and charge-sheet in the present case has already been filed; the trial of the case will take considerable time, therefore, further custody of the petitioner [2025:RJ-JP:23278] (2 of 2) [CRLMB-6952/2025] would not serve any fruitful purpose, so, petitioner be released on bail. 3. Learned Additional Government Advocate has opposed the submissions made by the learned counsel for the petitioner. 4. Heard learned counsel for both the parties and perused the material available on record. 5. Considering the fact that the petitioner is in custody since 27.03.2025 and the fact that the trial/investigation of the case may take considerable time, thus, without commenting any opinion on the merits/ demerits of the case, I deem it just and proper to allow this bail application. 6. Accordingly, the bail application under Section 483 Bharatiya Nagarik Suraksha Sanhita, 2023 is allowed and it is ordered that the petitioner Vijay Kumar Gurjar @ Bijju S/o Shri Ramnivas shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned Trial Court for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so. 7. It is also made clear that the petitioner shall not tamper with any evidence nor would influence the witnesses in the case. (MANEESH SHARMA (V. J.)),J SOURAV /139
