JUSTICE A. GUNESHWAR SHARMA O R D E R 16-09-2025 [1] Heard Mr. N. Jotendro, learned senior counsel assisted by Md. Syed Murtaza Ahmed, learned counsel for the petitioners and Mr. H. Debendra, learned Dy. Advocate General assisted by Mr. A. Bheigya Meitei, learned junior Government counsel on behalf of the State respondents. [2] Being aggrieved by the order dated 12-09-2025 issued by the Sub- Divisional Officer, Porompat, Imphal East in Eviction Case No. 10 of 2025/SDO(P)/IE directing the petitioners and others for removal of their structures upon the Government land, the petitioners filed this present writ petition.. Earlier the petitioners approached this Court by way of a writ petition being WP(C) No. 136 of 2018 and vide order dated 27-04-2022, they were permitted to file a fresh application for allotment to the Deputy Commissioner, Imphal East. Since the same could not be done, the WP(C) No. 734 of 2025 & MC(WP(C)) No. 685 of 2025 petitioners filed another writ petition being WP(C) No. 310 of 2025 challenging the subsequent order of eviction dated 08-04-2025. Subsequent eviction order was issued as the petitioners did not comply with the direction of this Court to approach the competent authority for allotment. However, vide order dated 21-04-2025, this Court granted six weeks’ time to the Deputy Commissioner, Imphal East to pass a speaking order to the representation dated 11-04-2025 submitted by the petitioners in terms of the earlier order. Thereafter, the petitioners also filed an application for allotment of the land under their occupation and the application is still pending. [3] During the pendency of the application for allotment, the SDO, Porompat, Imphal East issued an impugned order dated 12-09-2025 directing for removal of structures of the petitioners from the land under consideration for allotment. It is submitted that the impugned order be set aside as the application is pending. [4] Mr. H. Debendra, learned Dy. Advocate General for the State respondents, submits that he has no instructions upon the pending application for allotment filed by the petitioners. [5] However, Mr. N. Jotendro, learned senior counsel for the petitioners, draws the attention of this Court to a copy of the letter dated 15- 05-2025 sent by the Assistant Commissioner, Imphal East to the Director, Settlement and Land Records, Manipur for making an enquiry with respect to the application for allotment submitted by the petitioners and it is submitted that the proceedings are pending. [6] In the circumstances, if any application for allotment filed by the petitioners is pending before the authority, the competent authority is WP(C) No. 734 of 2025 & MC(WP(C)) No. 685 of 2025 directed to pass an appropriate order within three weeks. Till the passing of such order, status quo as on date shall be maintained. [7] With this observation, the writ petition is disposed of. [8] MC(WP(C)) No. 685 of 2025 is accordingly disposed of.
