This appeal is directed against the order dated 16.06.2025 passed in ABP No. 293 of 2025 arising out of Borio PS Case No. 220 of 2022 by the learned Sessions Judge, Sahibganj, whereby and whereunder, the prayer for anticipatory bail of the appellant has been rejected. It has been alleged that the younger brother of the informant was taken away by the accused persons on the assurance of providing education to him but subsequently for the last several years the informant has not been allowed to talk to her brother and therefore, it has been alleged that the accused persons have sold the brother of the informant. Submission has been advanced by the learned counsel for the appellant that the appellant is also the brother of the informant and the victim. It has been submitted that Kuldeo Sah and Pappu Sah are named in the First Information Report and both have been acquitted by the learned trial Court. The learned counsel adds that the present appellant was cited as a witness and since he had been declared hostile by the prosecution, in the supplementary investigation the name of the appellant was inserted. The learned counsel submits that one of the co- accused Amarnath Sah has been granted anticipatory bail by this Court in Cr. Appeal (DB) No. 594 of 2025. Learned Spl.P.P. has opposed the prayer for bail of the
appellant.
On consideration of the manner of implication of the appellant as depicted by the learned counsel for the appellant, we while setting aside the order dated 16.06.2025 passed in ABP No. 293 of 2025 arising out of Borio PS Case No. 220 of 2022 by the learned Sessions Judge, Sahibganj, direct the appellant to surrender before the learned trial court within four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Sahibganj in connection with Borio PS Case No. 220 of 2022, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
