2. This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, Abdul Khalek, praying for regular bail in connection with Panbazar P.S. Case No. 259/2025 registered under Sections 103(1)/118(2)/3(5) of BNS, 2023. 3. The case arose out of an FIR dated 08.08.2025 lodged by police official with allegation about finding an injured person, who was taken to hospital and subsequently, dead. It is also alleged that another injured person found in that area and he was also hospitalized. It is also alleged that in the early hours, these victims were assaulted by some shopkeepers of that area suspected them of theft. Nine Persons have been named as accused/suspect including the present petitioner. 4. The present accused person seeking bail was arrested on 09.08.2025 and presently in judicial custody. 5. The learned counsel for the petitioners places orders of this Court granting bail to three co-accused, who are also named in the FIR. 6. The learned counsel for the petitioner submits that he denies the involvement of the present petitioner in the present case. 7. The case diary has been received and the learned Addl. P.P. Mr. D.P. Goswami, submits that there are incriminating materials against the present accused, who apart from FIR named is also been implicated by witnesses as having participated in the assault upon the victim and that he had assaulted him with a pipe. 8. However, the investigation has progressed sufficiently and stated to be pending largely for collection of forensic report. Several FIR named co-accused have been granted bail. The present accused was arrested along with others on
Page No.# 3/3 09.08.2025 and since then he was in detention.
It is also submitted from the petitioner side that during investigation, he was also taken into police remand for five days and custodially examined thoroughly. 9. Keeping the aforesaid facts and circumstances and also the aspect of parity - the accused/petitioner herein is allowed to go on bail of Rs. 30,000/- with one surety of like amount to the satisfaction of the concerned learned Court and subject to the following conditions that:- (i) That the accused shall not commit any illegal activities or offence; (ii) That the accused shall not hamper or tamper with evidence. 10. Violation of bail conditions might entail cancellation of the bail. 11. This bail application stands allowed and disposed of. JUDGE Comparing Assistant
