The present anticipatory bail application has been filed seeking anticipatory bail in case crime No. 299/2025, under Sections 8/15/29/60(3) NDPS Act, P.S. Jaidpur, District Barabanki. Heard learned counsel for the applicant and learned A.G.A. for the State. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case solely on the basis of the confessional statement of a co-accused. Learned A.G.A., on the other hand, has opposed the anticipatory bail application, contending that the applicant has a chequered criminal history, which includes two cases under the NDPS Act. A perusal of the impugned rejection order indicates that while dismissing the bail application, the learned court below has recorded that the applicant has a criminal history of six cases. And Another .....Opposite Party(s) एक्ट, थाना जैदपुर बाराबंकी। 2-मु0अ0सं0 274/2021. धारा 3(1) यू०पी० गैंगेस्टर एक्ट, थाना जैदपुर, बाराबंकी। 3-मु०अ०सं० 488/2022. धारा 506 भा०द०सं० व धारा 3(1) द एस०सी०/एस०टी० एक्ट, थाना जैदपुर, बाराबंकी। 4-मु०अ०सं० 62/2024, धारा 8/15/29/60 (3) एन०डी०पी०एस० एक्ट, थाना जैदपुर, बाराबंकी। 5-मु०अ०सं० 115/2024, धारा 3/25 आयुध अिधिनयम, थाना जैदपुर, बाराबंकी। 6-मु०अ०सं० 38/2024, धारा 8/18 एन०डी०पी०एस० एक्ट, थाना मानकनगर, जनपद लखनऊ।" Upon due consideration of the fact that the applicant has a criminal history, including Case Crime No. 94 of 2021 under Sections 376D IPC, along with offences under the S.C./S.T. Act and the POCSO Act, as well as cases under the Gangsters Act and two cases under the NDPS Act, this Court finds that in light of such antecedents, it would not be appropriate to exercise the extraordinary jurisdiction of granting anticipatory bail. Accordingly, the application for anticipatory bail stands dismissed. At this stage, learned counsel for the applicant prays that liberty may be granted to the applicant to file a regular bail application, which may be decided expeditiously. In view of the said prayer, it is directed that in case the applicant files a regular bail application within two weeks from today, the same shall be considered and decided expeditiously in accordance with law.
