05/25.09.2025 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Lalmatia P.S. Case No.27/2025, registered for the offence under Sections 376(2)(n), 494, 313 and 498-A of the Indian Penal Code, pending in the Court of the learned Judicial Magistrate, 1st Class, Godda.

Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case. He further submits that the informant is aged about 33 years and the allegations are made that the relationship was established in the year 2010 itself, whereas, the FIR has been lodged on 22.03.2025. He then submits that false allegations are made against the petitioner and even Section 376(2)(n) of the Indian Penal Code has also been inserted in the case.

Learned counsel appearing for the State opposed the prayer and submits that on the pretext of marriage, the relationship was established.
5. Looking into the contents of the FIR, it transpires that the informant is aged about 33 years and she has stated that the relationship was established

in the year 2010 itself and, thereafter, at several places the petitioner and informant have met and even in Hazaribagh, they were in live-in relationship till June, 2021 and the FIR has been lodged on 22.03.2025. In the attending
facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Godda in connection with Lalmatia P.S. Case No.27/2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
