Learned counsel for the appellant , at the very out set, submits that the present F.A.F.O. has been preferred against an order dated 09.10.2024 passed by learned Additonal Civil Judge (Senior Division) Raebareli in Original Suit No. 41 of 2020 whereby an application 6 Ga-2 filed by the plaintiff/respondent for temporary injunction has been allowed ex-parte. Thereafter the said application filed by the plaintiff-respondent was dismissed on merits on 17.10.2025 during pendency of appeal, therefore, the appeal has lost its efficacy in change circumstances. The appellant has reserved his liberty to assail the impugned order dated 09.10.2024 as well as the subsequent order dated 17.10.2025 passed by the courts below before the appropriate judicial forum, to seeks leave of this Court to withdraw the present appeal. Accordingly, the appeal is dismissed as withdrawn with liberty as prayed for if the same is permissible under law. Office is directed to return certified copy of the impugned order to counsel for the appellant after retaining the photo copy of the same on record.
