ORAL ORDER The present petition is filed by the petitioner/wife seeking transfer of M.C.No.7135/2024 filed by the respondent/husband pending on the file of the II Additional Principal Judge, Family Court, Bengaluru, to the Court of Principal Judge, Family Court, Mysore.
2. The parties are referred to as husband and wife for the sake of convenience.
3. The facts of the case are that the marriage between the parties was solemnized on 18.11.2015. In view of the differences between the parties, the wife started residing at Mysore, along with her parents and her children who are aged about 7 and 1 year old. Thereafter, the husband had instituted M.C.No.7135/2024 on the file of the II Additional Principal Judge, Family Court, Bengaluru, seeking restitution of conjugal rights. It is submitted that the wife is residing at Mysore and the distance between Mysore and Bengaluru is about 150 kilometers and it is difficult for the wife to travel. Further, she

has to take care of the two children who is aged 7 and 1 year old.
4. This matter came up on 16.04.2025 and as there was no representation on behalf of the respondent, the matter was
directed to be listed today under the caption 'part heard'. Today also, there is no representation on behalf of the respondent. Hence, this Court is proceeding to pass orders on the merits of the matter.
5. Having heard the learned counsels on either side, perused the entire material on record. M.C.No.7135/2024 is filed before the II Additional Principal Judge, Family Court, Bengaluru and the wife is residing at Mysore along with two children who are aged 7 and 1 years old. The distance between Mysore and Bengaluru is about 150 kilometers. Considering the inconvenience that is being caused to the wife, this Court deems it appropriate to pass the following order:
ORDER i. M.C.No.7135/2024 filed by the respondent pending on the file of the II Additional Principal Judge, Family Court, Bengaluru, is withdrawn and

the same is transferred to the Court of Principal Judge, Family Court, Mysore. ii. The wife shall cooperate with the trial. iii. Accordingly, the Civil Petition is allowed. iv. All I.As. in this Civil Petition shall stand closed.
