PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the petitioner/A7 for granting of pre-arrest bail in connection with Crime No.81 of 2025 of Hanuman Junction Police Station, Krishna District, registered for the alleged offence punishable under Section 307of Bharatiya Nyaya Sanhita (for short ‘the BNS’). 2 2. The case of the prosecution, in a nutshell, is that the informant/victim is an Aqua Farmer and he was transporting broken piece rice to feed the fish on 02.05.2025 at 6.30 hours in a van bearing No.AP-39-UA-6307. When the van reached near Kanumolu Village, it broke down and then the driver parked the said vehicle on the road side, and at that time A1 to A6, one after another approached the victim and started threatening him that they would book him for the illegal transportation of rice. In the meantime, the petitioner/A7 said to be a Journalist, came there, and they all demanded money. A1 tried to stab the driver of the vehicle with a broken beer bottle. All the accused forcibly snatched Rs.30,000/- and an i-Phone from the victim. While leaving the place, all the accused confined the victim and others in the said van by locking the same from outside. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 4. Sri Sayyed Babu Shaik, learned counsel for the petitioner submits that the petitioner has not committed any offence and he was falsely implicated in this case. The petitioner would abide by any condition to be imposed by this Court. 5. Per contra, Ms. P. Akila Naidu, the learned Assistant Public Prosecutor, opposed in granting of bail stating that the petitioner has indulged in the offence highhandedly, there is prima-facie case is made out against the petitioner; some more material witnesses have to be examined; investigation 3 is not completed; if the petitioner is enlarged on bail, he would not be available for the investigation and he would escape from the clutches of law; and urged to dismiss the bail petition. 6. As seen from the averments in the FIR, specific overt acts are attributed to the petitioner/A7, who, along with more than five others, allegedly extorted money from the defacto complainant on the road under the threat that he is a journalist and would inform officials about the illegal transportation of paddy rice. It is also alleged that the petitioner wrongfully confined the defacto complainant and others in a vehicle by locking the door from the outside. LWs 1 to 5 have specifically testified about the role played by petitioner/A7. There are no merits in the petition. Hence, this Criminal Petition is dismissed. 7.
