Heard the counsel for the applicant. The present contempt application has been filed pleading willful disobedience of the order dated 26.2.2024 passed by this Court in Writ - A No. 2959 of 2024. It has been stated by the counsel for the applicant that the regular pension and other benefits to the petitioner / applicant under Rules, 2011 are being paid, however, Rs.18,00,000/- have been recovered from the applicant ostensibly because of excess payment due to erroneous fixation of salary. It is claimed that the aforesaid recovery is in disobedience of the order dated 26.2.2024. The contention of the counsel for the applicant is not acceptable. The legality of the recovery proceedings and the recovery of excess payment from the retiral dues of the applicant is to be considered before the appropriate forum and not in proceedings under the Contempt of Courts Act, 1971.
