Heard learned counsel for petitioner and learned State Counsel for opposite parties. 2. Petition has been filed seeking following relief(s):- (i) Issue a writ, order or direction in the nature of mandamus directing and commanding the Opp. Party no.2; Commissioner Evam Registrar, Co-operative, Lucknow to pay regular salary, arrear of salary and bonus from 01.07.2020 to the Petitioner according to the pay fixation dated 20.01.2023 to the petitioner as early as possible within stipulated period, in the interest of justice." 3. It has been submitted that the aforesaid emoluments have already been sanctioned by the competent authority vide order dated 20.01.2023, but actual payment thereof has not been made. 4. Considering the submissions made by learned counsel for petitioner, opposite party No.2, i.e., Commissioner Evam Registrar, Co-operative Societies, Lucknow, is directed to ensure payment of benefits claimed by petitioner, in case same have already been sanctioned and there is no legal impediment. The actual payment shall not be denied only on the ground of paucity of funds with the Co-operative Department.
