HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 6176 of 2025 Court No. - 17 HON'BLE SUBHASH VIDYARTHI, J.
1. Heard Ms. Pragya Pandey, Advocate holding brief of Shri Prabhat Kumar Upadhyay, the learned counsel for the petitioner.
2. By means of the instant petition, the petitioner has sought issuance of a direction to the Civil Judge (S.D.) Pratapgarh for expeditious disposal of Suit No.482 of 2008 titled Muneshwar v. Anara Devi. The petitioner is defendant in the aforesaid suit and an order of temporary injunction was passed in the suit on 28.05.2016 directing the opposite parties to maintain status-quo.
3. The learned counsel for the petitioner has submitted that since there is an order of temporary injunction operative in favour of the plaintiff, the defendant is suffering because of continuance of the aforesaid injunction order and long pendency of the suit which is pending since the year 2008 and is about 17 years old.
4. In these circumstances, the petition is disposed of directing the Civil Judge (S.D.) Pratapgarh to proceed with hearing of Suit No.482 of 2008 expeditiously and conclude the same at the earliest without granting any unnecessary adjournment to any of the parties and by fixing the dates at short intervals.
