HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 1538 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for applicant as well as learned Additional Government Advocate for State. The present application for anticipatory bail has been filed for protection in regard to Case Crime No. 264 of 2024, 2419300/Ss. 406 & 420 IPC, Police Station - Amethi District Amethi. It is alleged in the prosecution case that the applicant, in connivance with the co-accused persons, induced the complainant to invest in land. It is alleged that between 2016 and 2022, the complainant, having sold his land, disposed of his wife’s jewellery, and borrowed money from his relatives, paid a total sum of Rs. 1,03,14,000/- to the applicant and the co-accused persons. However, instead of utilizing the said amount for purchasing the plot, the applicant and his associates misappropriated the money and spent it elsewhere. Learned A.G.A. submits that in Parcha No. 4 of the case diary, the statement of the applicant was examined by the Investigating Officer, who found that an amount of Rs. 70,000/- had been transferred from the complainant’s account to the applicant’s account on 13.07.2021. It is further submitted that the learned trial court, while rejecting the anticipatory bail application, has duly taken note of this fact. Perused the record.A perusal of the rejection order shows that the prima Versus Counsel for Applicant(s) : Birendra Pratap Singh Counsel for Opposite Party(s) : G.A. Mohd. Hence, no case for grant of anticipatory bail is made out. The anticipatory bail application is dismissed. October 16, 2025 R.C. NABAIL No. 1538 of 2025 2 (Karunesh Singh Pawar,J.)
