Choudhury, learned counsel for the petitioner and Mr. K.K. Parashar, learned Addl. Public Prosecutor for the State. By this application, the petitioner has sought for bail in connection with Mikirbhita P.S Case No. 107/2025 corresponding to G.R Case No. 1061/2025 under Section 316(2)/318(4)/319(2) of the BNS, 2023. The FIR dated 19.08.2025 reveals that one woman namely, Trishna Devi has been cheating innocent villagers by giving false information about Government Scheme. It is stated in the FIR that the said woman had collected the account details of different women of the village on the ground that Government money would be deposited in their account but it was found out that money in respect of pregnant mothers are being deposited in the account of various women in the village and it is also stated that in the process, the said woman namely, Trishna Devi had collected lots of money from various village people. It is also stated that the said woman Trishna Devi and associates have been doing the said illegal work. Mr. B. Choudhury, learned counsel for the petitioner submits that the petitioner was issued notice under Section 35(3) of BNSS, 2023 however, she could Page No.# 3/4 not appear for valid reasons and as such, has apprehension that she may be arrested in the instant case. Mr. K.K. Parashar, learned Addl. Public Prosecutor however submits that in order to get the entire fraudulent activity revealed, the Case Diary would be required in the instant case and has prayed for calling of the same. On consideration of the submissions made by the parties, more so in view of the fact that the main accused person in the said FIR was stated to be Ms. Trishna Devi without any involvement of petitioner, this Court finds it fit to release the petitioner on pre arrest bail on furnishing a bail bond of Rs. 20,000/- with one (1) local surety of the like amount to the satisfaction of the Arresting Authority with the following conditions:- (1) The petitioner shall cooperate with the investigation and appear before the Investigating Officer within a period of five (5) days from the date of the order as well as whenever called for. (2) The petitioner shall not tamper with the evidence or influence any of the witnesses. (3) The petitioner shall not leave the jurisdiction of the Arresting Authority without the permission of the authority. Page No.# 4/4 Petition is disposed of. JUDGE Comparing Assistant
