2 Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 24-04-2025 1) Petitioner has filed this petition assailing the order passed by the SDO(R), Janjgir dated 02.07.2020 whereby the operation of Fair Price Shop situated at Village- Amora being operated by the petitioner’s society has been cancelled. 2) Learned counsel appearing on behalf of respective respondents submit that the order impugned is appealable according to the provisions of Clause 18 of the PDS Control Order, 2016, therefore, this petition is not maintainable and deserves to be dismissed. 3) Taking into consideration the fact that there is efficacious alternative remedy available to the petitioner to prefer appeal before the concerned Collector as per Clause 18 of the PDS Control Order, 2016, in the opinion of this Court, this petition is not maintainable. 4) Consequently, this petition fails and is hereby dismissed. However, petitioner would be at liberty to avail the remedy available under law. Sd/- (Rakesh Mohan Pandey) JUDGE Ajinkya
