HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 10190 of 2025 Court No. - 3 HON'BLE SHEKHAR B. SARAF, J.
HON'BLE PRASHANT KUMAR, J. Heard learned counsel appearing on behalf of the petitioner and the learned Standing Counsel appearing on behalf of the State. The writ petition has been filed with following prayers:-
"i) a writ or writs in the nature of certiorari quashing the impugned order dated 19.05.2025, passed by opposite party no.4, in Case No.5231 of 2025, under Section 38(3) of U.P. Revenue Code, 2006, as contained in Annexure No.1 to the writ petition and ii) a writ, order or direction in the nature of mandamus, commanding the opposite parties to expunge the entry of Khalihan from the petitioner's land recorded in revenue record and to make entry on the petitioner's land which was existing earlier as Bagh in the name of ancestors of petitioner, now to make entry in the name of petitioner, who is present in actual and physical possession of the land in question, and iii) A writ, order or direction in the nature of mandamus, restraining the opposite parties from making any type of interference in peaceful physical possession and enjoyment of the petitioner over the land in question and not to evict the petitioner from the land in question on the basis of illegal entry of Khalihan in revenue record." Learned Standing Counsel appearing on behalf of the State Versus Counsel for Petitioner(s) : Ganga Singh Counsel for Respondent(s) : C.S.C. Vinod Kumar Pandey .....Petitioner(s) State Of U.P. Thru. Chief Secy. Lko. And 6 Others .....Respondent(s)
submits that this writ petition is filed by suppression of material facts. In fact a number of cases with regard to the same property are pending which have not been divulged in the writ petition. On being asked from learned counsel for the petitioner as to where the pending cases are mentioned in the writ petition, no fruitful reply is received from him. In the light of the same, we are of the view that there is material suppression of facts and petitioner has not come to this Court with clean hands. In view of the aforesaid, the writ petition is dismissed. Upon the prayer made by learned counsel for the petitioner, we, however, grant liberty to the petitioner to file appropriate appeal under the U.P. Revenue Code, 2006.
