HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL REVISION No. - 1166 of 2025 Court No. - 27 HON'BLE MANJIVE SHUKLA, J.
1. Heard Sri Rajesh Kumar, learned counsel for the revisionist and learned Additional Government Advocate appearing for the State. 2. The captioned criminal revision has been filed challenging therein, the order dated 11.07.2025 passed by the Juvenile Justice Board, Gonda in Case No.163 of 2025; State vs. Satendra Chaube, arising out of Case Crime No.69 of 2025 registered under Sections 140(2), 317(2) BNS, 2023 and Sections 25/27/30 Arms Act, Police Station Motiganj, District Gonda, whereby application filed by the revisionist for grant of bail had been rejected. The revisionist through this revision has also challenged the order dated 16.09.2025 passed by the Additional Sessions Judge/Special Judge P.O.C.S.O. Act, Gonda in Criminal Appeal No.69 of 2025, whereby the order passed by the Juvenile Justice Board had been upheld. 3. It has been contended on behalf of the revisionist that there are three accused of Case Crime No.69 of 2025, out of which revisionist is a juvenile. It has further been contended that out of three accused except the revisionist, other co-accused have already been granted bail by this Court vide orders dated 04.09.2025 and 09.10.2025 passed in Criminal Misc Bail Application Nos. 6263 of 2025 and 9666 of 2025, respectively. It has also been contended that role of all the three accused is identical, therefore, the revisionist is also entitled to be released on bail. 4. Learned A.G.A appearing for the State though has opposed the prayer for grant of bail but could not dispute that role of all the three accused is identical. 5. I have considered the arguments advanced by the learned counsels for the parties and I find that two main accused of Case Crime No.69 of 2025 have Versus Counsel for Revisionist(s) : Rajesh Kumar Counsel for Opposite Party(s) : G.A. Juvenile Offender S Thru. His Natural Guardian Father .....Revisionist(s) State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Home Lko. And Another .....Opposite Party(s)
already been granted bail by this Court, therefore, there is no reason to deny bail to the present revisionist. 6. Keeping in view the overall facts and circumstances of the case, this Court is of the view that the revisionist is entitled for being enlarged on bail. 7. Accordingly, this criminal revision is allowed.
The order dated 11.07.2025 passed by the Juvenile Justice Board, Gonda and the order dated 16.09.2025 passed by the learned Additional Sessions Judge/Special Judge P.O.C.S.O. Act, Gonda, are hereby set-aside. 8. The trial court/competent court/Juvenile Justice Board, Gonda is hereby directed to enlarge the revisionist on bail in aforesaid case crime number on furnishing two sureties and a personal bond to the satisfaction of the court concerned.
