W.P.No.1182 of 2022 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED : 19.12.2025 CORAM : THE HONOURABLE MR. JUSTICE S.M.SUBRAMANIAM and THE HONOURABLE MR.JUSTICE C.KUMARAPPAN W.P.No.1182 of 2022 P.Pichap Pillai ..Petitioner Vs. 1. The Collector & Chairman, District Rural Development Agency, Cuddalore – 607 001 2. The Revenue divisional Officer, Vridhachalam, Vridhachalam Taluk, Cuddalore District. 3. The Revenue Tahsildar, Veppur, Veppur Taluk, Cuddalore District. 4. The Block Development Officer, Mangalur Panchayat Union, Veppur Taluk, Cuddalore District. 5. The Special officer/ Executive Officer, Keezh Orathur Panchayat, Veppur Taluk, Cuddalore District. ..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India to 1/5 https://www.mhc.tn.gov.in/judis W.P.No.1182 of 2022 issue a Writ of Certiorarified mandamus to call for the records and quash the impugned order dated 16.11.2021 passed by 3rd respondent in his proceedings Na.Ka.Aa2/319/2021 and consequently direct the respondents to restore Ayyanar Koil Street, running through T.S.Nos.69, 70, 71, 72, 81, 82, 94 and 95 of Keezh Orathur Village, veppur Taluk, Cuddalore District. For Petitioner : Mr.D.Baskar For Respondents : Mr.T.Arunkumar, Addl.G.P. for R1 to R3 No appearance for R4 & R5 O R D E R S.M.SUBRAMANIAM,J. Writ on hand has been instituted to assail the order passed by the Revenue Tahsildar in proceedings dated 16.11.2021. 2. The 3rd respondent in the impugned order formed an opinion after adjudication that the “Nilaviyal Paathai” can be used by the petitioner and there is no impediment for such usage. As far as the “Nilaviyal Paathai” in patta lands are concerned under RSO No.26(15), the Government has to protect the same as pathway to be utilised for common purpose by the public. The Tahsildar, after considering the issues made a finding that the petitioner and the public shall utilise the said pathway and there is no 2/5 https://www.mhc.tn.gov.in/judis W.P.No.1182 of 2022 impediment for the same. 3. Learned counsel for the petitioner would submit that “Nilaviyal Paathai” is to be relaid. 4. The question of relaying such “Nilaviyal Paathai” would not arise at all, since “Nilaviyal Paathai” is maintained as a mud road and it is to be maintained as it is. The Government may not allocate funds for laying roads in respect of such pathway classified as “Nilaviyal Paathai” situated in patta lands and therefore, such claim set out by the petitioner is unacceptable. Therefore, this Court does not find any infirmity in respect of the order impugned in the writ petition. Consequently, the Writ Petition stands dismissed. No costs. (S.M.S.,J.)
