Present writ petition has been filed by the petitioner seeking following relief(s):- (I) Issue a writ, order or direction in the nature of mandamus for direction to opposite parties for payment of entire gratuity amount of Rs.9,83,024/- to the petitioner (as mentioned in P.P.O. order dated - 07.12.2023 of the petitioner) along with 18% interest per annum, which has not been paid to him till date after passing of more than Four Years of his retirement on 31.07.2021 from the post of "Assistant Horticulture Inspector" after superannuation of age, in the light of judgment & order dated - 17 August, 2022, passed by coordinate bench of this Hon'ble Court in Writ - A No.2461 of 2015, "Brajendra Kumar Singh Vs. (The P.P.O. order dated - 07.12.2023 of the petitioner & judgment & order dated - 17 August, 2022, passed by this Hon'ble Court in Writ - A No.-2461 of 2015, Versus Counsel for Petitioner(s) : Surendra Kumar Tripathi, Hari Krishna Srivastava, Sweta Swarankar Counsel for Respondent(s) : C.S.C. Bhaskar Prasad Pandey .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy. Horticulture And Food Processing Lko. And 2 Others .....Respondent(s) "Brajendra Kumar Singh Vs. State of U.P. thru. Since considering petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file fresh representation before opposite party no.2 i.e. Director, Horticulture & Food Processing Department, Uttar Pradesh, Udyan Bhawan, Sapru Marg, Lucknow who shall consider and decide the same within a period of three weeks from the date of receipt of fresh representation along with a certified copy of this order. In case petitioner is found entitled for the aforesaid benefits, actual payment shall be ensured within a period of two weeks thereafter. 4.
