Chauhan, learned counsel for the petitioners, Sri Piyush Kumar, learned counsel for opposite parties no. 1 and 2 and Sri Prashant Kumar Singh, learned counsel for the opposite parties no. 3,4 and 5. By means of this petition the petitioners have prayed following relief : "i) Issue a writ, order and direction in the nature of mandamus to commanding the opposite parties to consider and make the payment of post retiral dues and pension under 'Old Pension Scheme' and paid the pension and other post retiral dues in accordance to the Old Pension Scheme to the Petitioners within time stipulated by this Hon'ble Court, with all consequential benefit. ii) Issue a writ, order or direction in the nature of mandamus commanding the opposite parties to make the payment of post retiral dues and pension as per judgment passed by Hon'ble Supreme Court in the case of Prem Singh v. State of U.P. and Others reported in 2019 (10) SCC 516 as well as Writ - A No. 8968 of 2022 decided on 17.02.2023 within the time stipulated by this Hon'ble Court." Learned counsel for the petitioners has submitted that ends of justice would suffice if he is allowed to move a fresh representation before the opposite party no. 3 and the same may be directed to dispose it of with speaking and reasoned order within stipulated time. With the consent of parties the writ petition is disposed of finally at the admission stage. If such a representation is moved the opposite party concerned is directed to dispose of the representation of the petitioners with speaking and reasoned order after affording an opportunity of hearing to the parties concerned, strictly in accordance with law expeditiously, say within a period of two months from the date of production of the certified copy of this order.
