GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the inaction of the respondents 2, 4 to 6 more particularly that of respondents 4 to 6 in not registering a crime, though the occurrence disclosed commission of cognizable 2 offences against the accused punishable U/s. 323, 341,354, 390, 451, 506 I.P.C as illegal, arbitrary and violative of the provisions of criminal procedure code, Article 21 of Constitution of India. and against the law laid down by the Supreme court and also direct the 3rd respondent to register a crime basing on the report made by the petitioner / victim about the incident that has taken place at 11.00 A.M on 28-07-2020 at her house and investigate the case and file charge sheet against the accused in the interests of justice, or else the petitioner would suffer irreparable loss and injury which cannot be compensated otherwise.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that based on the complaint given by the Petitioner, the Police conducted thorough investigation and examined the witnesses and found that the allegations leveled by the Petitioner in the said complaint are baseless and hence, addressed a letter to the Superintendent of Police to close the case. 3. Sri M.Chalapati Rao, learned counsel for the Petitioner would submit, recording the same, that the petition may be disposed of. 4. Considering the submissions made, the Writ Petition is disposed of giving liberty to the Petitioner to work out her remedies before appropriate forum in accordance with law. There shall be no order as to costs.
