Versus The State of Jharkhand … Opp. Party(s). …… CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Vikram Singh, Advocate For the State : Mr. Prabir Kr. Chatterjee, Spl. P.P. …...... 02/ 24.07.2025: Heard, learned counsel for the petitioners and learned counsel for the State. 2. The present anticipatory bail application under Sections 482 and 484 of the Bhartiya Nagarik Suraksha Sanhita has been preferred by the petitioners apprehending their arrest for the offences registered under Sections 406, 420, 468 and 471 of IPC. 3. The learned APP opposes the prayer for anticipatory bail. 4. F.I.R. is at the instance of the Central Coalfields Limited. It is stated that order was issued in favour of one M/s Mohit Minerals Limited for lifting of coal. M/s Mohit Minerals Limited handover the work to one Mohan Ojha as his authorized person. Mohan Ojha has issued an affidavit in favour of one Rakesh Kumar to the execute the work. Rakesh Kumar by forging the signature issued gate passes illegally by using those papers and allowed some trucks to enter the area. There is no allegation against these petitioners, who happens to be the owner of the Hywa vehicles. Since, the entire allegation is against Rakesh Kumar, I feel that this is a fit case for grant of anticipatory bail of the petitioners. Accordingly, this anticipatory bail application stands allowed. 5. The petitioners, above named, are directed to appear before the learned Court below within three weeks from the date of receipt of copy of this order and on their appearance, they shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Chatra, in connection with Tandwa P.S.
