Rayavaram police statI'On, Anakapalli DistrI'Ct. 2. A case has been registered agaI|nSt the petitioners and others for the offences punishable under sections 2O(b)(ii)(C), 25 r/w 8(c) of the Narcotic Drugs and psychotropic substances Act, 1985. 3. Case of the prosecution, in brief, is that, on o2.01.2025 at 10.00 hours, on receipt of credible information about iI]ega[ transportation of ganja, the sl of Police, Kotauratla police station, In- charge of s. Rayavaram police Station, along with hI'S Staff and mediators, rushed to NH-16 Highway, Gurra NanajiJs fields, back side to sri srinivasa Lodge and found Al and A2 sl'tting in a car bearing No.AP40 BH 3733 parked under a treel on verification, it is found that car was loaded with 110 Kgs of ganJ'a| The accused persons were taken into custody and contraband was seized under the cover of mediators report. '``\,'\ 3=F-P=.= =-F' 2 ~| 4. Learned counsel for the petitioners submits that the petitioners were shown as Accused Nos.4 and 6 basing on the confessional statements of co-accused. The petitioners were remanded to judicial custody on 15.04|2025 and since then they are languishing in jail. 5. Learned Assistant Public Prosecutor submits that major portion of the investigation has been completed. -6I Heard. Perused the record. 7. A perusal o'fthe material on record goes to show that basing on the confessional statements of co-accused, the petitioners are shown as accused in the present crime. The contraband allegedly seized from the possession of the accused is 110 Kgs of ganJ-a. The Petitioners Were arrested and remanded to judicial custody on 15.04.2025 and since then they are in jail, Learned Assistant Public Prosecutor submits that maJ-Or portion Of investigation has been completed, but charge sheet is not filed for apprehension of A3 and A5 and that A6 belonging to Rajasthan State. However, learned counsel for the petitioners submits that A3 and A5 were arrested by the police. Since the entire case rests on the confessional statements of co-accused, this Court is inclined to release the petitioners on bail. 8. Accordingly, the Criminal Petition is allowed.
