HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 7869 of 2022 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Supplementary affidavit filed today is taken on record. 2. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record. 3. The applicant seeks enlargement on bail in FIR No.51 of 2019, under Section 302 IPC, Police Station Kotwali Nagar, District Sitapur. 4. It is argued by the Counsel for the applicant that two of the co- accused, namely, Mahendra Singh and Vijay Singh @ Ranvijay Singh have been enlarged on bail and the report sent by the trial court indicates that the case is at the final stage and the 14 witnesses have already been examined. 5. Learned A.G.A. vehemently opposed the bail prayer. 6. Considering the fact that all the witnesses have already been examined coupled with the fact that the applicant has no criminal antecedents and is languishing in jail since 09.02.2019 and there is nothing on record to demonstrate that the applicant if enlarged on bail, would in any way adversely affect the trial, I am of the view that the applicant is entitled to Versus Counsel for Applicant(s) : Pankaj Kumar Tripathi, Avinash Singh Vishen, Dhananjai Kumar Tripathi, Digvijay Singh, Mohd. Shahid Akhtar, Surya Prakash Tiwari Counsel for Opposite Party(s) : G.A., Arvind Kumar, Rakesh Kumar Yadav, Shyamendra Singh Upendra Singh Chauhan S/O Malkhan Singh (Second Bail) .....Applicant(s) State Of U.P Thru.
