HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 6174 of 2025 Court No. - 6 HON'BLE JASPREET SINGH, J. Heard learned counsel for the petitioner. Notice on behalf of respondent no.1 has been accepted by the office of Chief Standing counsel. In view of the order proposed to be passed by this Court, notice to the private-respondent is dispensed with. By means of the instant petition, the petitioner seeks expeditious disposal of his application for interim relief filed in a Revision bearing no.2263 of 2025 pending before the Board of Revenue. Submission of learned counsel for the petitioner is that by mis-statement of fact the Tehsildar has exercise of power of Revenue which is not vested in it to recall the order which was treated to be exparte though the said order had been passed at the behest and at the instance of the private respondent no.2 hence it could not be exparte. It is further urged that the order impugned is patently without jurisdiction which was assailed in the revision however, the application for interim relief has not been considered. Having considered the aforesaid prayer, this Court is of the opinion that no gainful purpose would be served in keeping the writ petition pending or call for counter affidavit. Since the revision is already engaging the attention of the Board of Revenue where the petitioner has moved an application for interim relief in as much as ends of justice can be met by directing the Board of Revenue to consider and decide the application for interim relief preferably on the date fixed 25.10.2025 and in case if the same is not possible then within four weeks thereafter after affording full opportunity of Versus Counsel for Petitioner(s) : Tanay Chaudhary Counsel for Respondent(s) : C.S.C. Vasvendra Singh .....Petitioner(s) Court Of Member (Judicial), Board Of Revenue, U.P. Lko. And Another .....Respondent(s)
hearing to the parties but without granting any unnecessary adjournment to either of the parties. It is made clear that the Court has not examined the case of either of the parties on merits and the authority concerned shall be free to decide the matter strictly in accordance with law. With the aforesaid, the petition is disposed of. October 16, 2025 Harshita A227 No. 6174 of 2025 2 (Jaspreet Singh,J.)
