For the respondents : Ms. Shikha, Advocate, vice Ms. Kiran Dhiman, Advocate. Jyotsna Rewal Dua, Judge This writ petition has been filed for the grant of following substantive reliefs:- “(i). That the respondents may be ordered to regularize services of the petitioner, as per the policy, on completion of 5 years’ service, with all benefits incidental thereof.” 2. Petitioner’s case is that his services were brought on daily wage establishment on 27.02.2017 but the same have not been regularized in spite of Regularization Policy framed by the State that provides for regularization of services after rendering five years of service. -2- 3. The respondents have pleaded in their reply that petitioner was appointed as part-time Sweeper in the year 2005. His services were brought on daily wage establishment on 27.02.2017. Respondents have further submitted that in category of the Sweeper, respondent-Corporation has total 21 sanctioned posts. Petitioner is at sixth position in the seniority list of daily wage employees in his category. As per policy, regularization can be made on the basis of seniority in accordance with law subject to availability of sanctioned post. 4. Since there are five more individuals senior to the petitioner in the seniority list of daily wage Sweepers, therefore, the stand of the respondents seems to be justified that the petitioner can be considered for regularization of his services in the order of seniority and subject to availability of a sanctioned post. It is also pertinent to note that the petitioner has not filed any rejoinder to rebut the factual averments made in the reply. 5. Taking note of the stand of the respondents in their reply, the writ petition is disposed of with direction that the case of the petitioner for regularization of his services be -3- considered in accordance with law, as per his seniority and the applicable policy for regularization.
