Mr.Abhijeet Singh Chauhan, Advocate, vice Mr.Raman Jamalta, Advocate, for respondent No.1. Mr.Arvind Sharma, Advocate, for respondent No.2. CMP(M) No.1390 of 2024 Despite availing opportunities reply to the application has not been filed since November 2024. However, prayer for condonation of delay has been opposed on the ground that day-to-day delay has not been explained as required to be explained under law. In para-2 of the application, applicant has stated that on account of nature of injuries suffered in the accident, he could not manage to file appeal for enhancement well in time with further submission that plea taken in para 2 of the application, is duly substantiated by the findings returned by the MACT. Taking into consideration averments made in the application, delay of one year 13 days in filing the appeal is condoned. Application stands disposed of. FAO No. of 2025(FAO33669/2024) Appeal be registered. Admit. Parties are duly represented, therefore, no fresh post admission notice is required to be issued. Records be requisitioned.
