The present MCC has been filed by the petitioner for modification of the order dated 07/04/2025 passed in WPS No.2320/2025 on the ground AMARDEEP CHOUBEY Digitally signed by AMARDEEP CHOUBEY Date: 2025.06.12 10:30:39 +0530 2 that due to clerical error, the contents of the entire order has been passed in respect of other case and now the petitioner is seeking the similar order as has been passed in WPS No.2225/2025. 2. No objection from other side. 3. Having considered the entire facts and circumstances of the case, the order dated 07/04/2025 passed in WPS No.2320/2025 from para 1 to 6 is hereby modified and passed the following order from para 1 onwards. I) By the present Writ Petition, the Petitioner who has retired from the post of Gardener from Municipal Corporation, Durg, is seeking a limited direction towards the Municipal Corporation to release the amount of gratuity as per its memo dated 11/11/2024 (Annexure-P/2). II) Learned counsel for the Petitioner submits that vide memo dated 11/11/2024 (Annexure-P/2), the Commissioner has informed to the Petitioner that the gratuity amount of the petitioner i.e. Rs. 2,44,246/- would be paid to him from the month of November, 2024 in installment of Rs. 50,000/- / 30,000/- per month, however, till date the same has not been released, despite the representation made by the petitioner on 03/03/2025 to the Commissioner, Municipal Corporation, Durg III) On perusal of memo dated 11/11/2024 (Annexure- P/2), it is quite vivid that the Commissioner has informed to the petitioner that the gratuity amount of the petitioner would be paid to him from the month of November, 2024 in installment of Rs. 50,000/- / 30,000/- per month, however, till date the same has not been released, despite the representation made by the petitioner to the Commissioner, Municipal Corporation, Durg on 03/03/2025. 3 IV) Hence, the Commissioner, Municipal Corporation, Durg is directed to take necessary steps for releasing of the amount of the gratuity in accordance with memo dated 11/11/2024 (Annexure-P/2) within a period of 30 days from the date of receipt of copy of this order. The petitioner is at liberty to apprize the order of this Court to the Commissioner. V) With the aforesaid directions, the writ petition is disposed of. 4. Accordingly, the MCC stands disposed of.
