HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 8991/2025 Shree Dau Baba T.T. College, Running By Shree Shikarwar Siksha Samiti, Village- Dhourmui, Tehsil- Bharatpur, District- Bharatpur Through Secretary Vijendra Kumar S/o. Late Shri Jaggannath Verma. ----Petitioner Versus Maharaja Surajmal Brij University, Bharatpur (Raj.) Through Its Registrar ----Respondent For Petitioner(s) : Mr. Manish Kumar Sharma For Respondent(s) : JUSTICE ANOOP KUMAR DHAND Order 14/07/2025 1. The instant writ petition has been preferred with the following prayer: “(i) By issuing writ, order or direction in the name thereof thereby, direct the respondent to refund the affiliation fee of Rs.3,27,000/- to the petitioner along with interest @24% per annum. (ii) Any other order or direction which this Hon’ble Court may deem fit, just and proper in the facts and circumstances of the case may also be passing in favour of the petitioner.” 2. By way of filing this writ petition, the petitioner is seeking directions against the respondents to refund the affiliation fee. 3. Learned counsel for the petitioner submits that for the academic session 2016-17, an application was submitted with (2 of 2) [CW-8991/2025] the requisite fee seeking affiliation, but no NOC was granted by the authority, hence, under these circumstances, the petitioner is entitled to get refund of affiliation fee. Counsel submits that several applications in this regard were submitted before the office of the Registrar of Maharaja Surajmal Brij University, Bharatpur, but no heed has been paid and the applications submitted by the petitioner have not been decided by passing a reasoned and speaking order, therefore, appropriate directions be issued to the University to decide the pending application within a time frame. 4. Considering the limited prayer made by counsel for the petitioner, the instant writ petition stands disposed of by issuing directions to the University to decide the application (pending, if any) expeditiously, as early as possible, preferably within a period six weeks from the date of receipt of certified copy of this order. 5. The stay application and all pending applications, if any, also stand disposed of. 6. Before parting with this order, it is made clear that this Court has not issued any direction/order to the respondent to decide the application in a particular way. The respondent would be at liberty to decide the same strictly in accordance with law by passing a reasoned and speaking order. (ANOOP KUMAR DHAND),J KuD/20
