The petitioners herein are the retired employees of Yogoda Satsanga College. It is their grievance that they have not been paid their amounts which they are entitled to receive under head of leave encashment. 3. Mr. Abhay Kumar Mishra, learned counsel appearing on behalf of the petitioners submits that earlier there was some disputes in respect of payment of leave encashment to the employees of minority institutions but now the same has been decided and it is the State who has to pay the amount. He submits that there are leave lying in the credit of the petitioners and thus, the said amount needs to be encashed and payment has to be made to the petitioners. 4. Mr. Anoop Kr. Mehta, learned counsel appearing on behalf of the Ranchi University submits that an exercise has to be undertaken by the college and an information has to be forwarded to the University by the college mentioning the number of days which is lying in the credit of each of the respective employees under leave. If any leave is there in the credit of each of the employees, then only the amount equivalent to the wages of the number of days which is in the credit of the petitioners would be paid by way of leave encashment. He submits that once the detail is received from the college, the University will forward the same to the State and the State will sanction the aforesaid amount. After the amount is sanctioned, the same is paid to each of the employees. 5. Mr. Piyush Chitresh, learned counsel appearing on behalf of the College submits that they will undertake the exercise and will inform the University the necessary details so that the admissible amount of leave encashment can be paid to the petitioners who are the retired employees. He submits that the said exercise can be concluded, if the petitioners cooperate, within 2025:JHHC:24229 3 three weeks. 6. Considering the submission, I direct the respondent- Yogoda Satsanga College to compute the number of days of leave which are lying in the credit of these petitioners and forward the same to the University within three weeks. The University thereafter will forward the same with their recommendation to the Government within two weeks thereafter. The University will also seek necessary funds. On receipt of the recommendation of the University, the State will arrange for the fund and disbursed the same to the University within three weeks thereafter. Once the confirmation is received from the State and the amount is disbursed by the State, the same will immediately disbursed to the petitioners through the College. It is expected that the entire process should be concluded within a period of 12 weeks from today. 7. With the aforesaid observation, this writ petition is disposed of. (ANANDA SEN, J.) Sandeep, cp3
